Terms of Service
1. Listing and Listing Fees
By listing gear on SizeUp, you agree to pay a $5 NZD listing fee. This fee covers the administrative costs of managing your listing and maintaining the SizeUp platform. Additionally, $2 of every listing fee goes directly to the local sports club, school, or PTA you select to support.
2. Ownership and Gear Responsibility
You are solely responsible for the condition, safety, and ownership of the gear you list. SizeUp is not responsible for any damage, loss, or theft of listed items. We strongly recommend that all buyers and sellers meet in public, well-lit locations to ensure the safety of all parties involved.
3. Direct Transactions and Payments
SizeUp does not handle or facilitate any payments between buyers and sellers. You are responsible for arranging and managing all financial transactions directly between yourself and the buyer. We encourage the use of secure payment methods and the use of a third-party escrow service if available.
4. Content and Community Standards
Users agree to provide accurate descriptions and honest photos of their gear. SizeUp reserves the right to remove any listing that violates community standards, including but not limited to harassment, fraud, or the listing of prohibited items. We are committed to a safe and respectful environment for all parents and clubs.
5. Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from the use of SizeUp shall be subject to the exclusive jurisdiction of the courts of New Zealand. We encourage all parties to resolve any disagreements through direct communication before seeking legal recourse.
